Notification of government
Employers are required to provide notification, hiring even those foreigners who are not required to have authorization documents for employment (p. 8 Art. 13 of the Law № 115-FZ Federal Law of November 24, 2014 № 357-FL). 1. There is overall liability for all employers – within three working days they should notify the FMS of Russia in the territorial entity where a foreigner works (who obtained a licence of his/her employment and dismissal). This regulation is valid for foreigners with or without visa (p. 8, Art. 13 of the Law № 115-FL, application number 21 to the FMS Order of Russia on June 28, 2010. № 147). If an employer does not do it, he/she can be given warning for two reasons. That is for hiring an employee without permission or a licence and without the notice of a conclusion of the employment agreement or the civil law contract (Ch. 1, 3 Art. 18.15 of the Administrative Offence Code of the Russia Federation). 2. Need to notify is abolished in the following cases: (Federal Law of November 24, 2014 № 357-FL): - Employment services in the territorial entities of the conclusion and termination of contracts with foreign employees; - FMS Agencies of Russia and employment services in the territorial entities of the Russian Federation are to notify a foreigner about the leave without pay of more than a month (the exception is the full-time students of Russian universities); - The tax authority during the employment, dismissal of a foreigner; - FMS Agencies of Russia are to notify about unpaid leave for foreign qualified professionals at the period of more than a month during the year and dismissal.
